omg.. also update on DVDs

Again not to point fingers or try to guilt trip people that haven't donated.

I just got donated 100 dollars by ONE PERSON

Gabby, that's just too generous, I feel like a freaking thief... i'm at a loss for words honestly..


Also to update you on the DVD thing, I'm not sure it's going to happen after all sadly, I just don't know about the copyright laws and all of that, and I don't want to risk it.

Also some among us (not naming names) aren't happy at all with the idea, so for now I think it's a no go.

so don't donate anything if you're wanting DVD's only until things are confirmed (which may not be).

Sorry about that.. I guess it's just my autograph for now.

  1. You can fix the Copyright Issues with a simple email to Chet Faliszek, the Head Producer of L4D, at valve...

    You're not claiming the content is yours (the game that is) nor are you making any official profits from it. You're simply taking donations, rather then saying "Here buy this".


    But if you don't want to do the idea then: :'( and alright.

  3. I'm not completely sure how it works, but you should become a youtube partner. I know a couple that I'm subscribed to that have less subscribers than you, and you put out videos pretty regularly. Just putting it out there because you need the money and you'd get to do what you like doing.

  9. Who cares who isn't happy with the DVD idea. If he's not gonna do it it's no big deal. It isn't like you can't just watch the videos on youtube where they've always been. Plus, I wouldn't want any lawsuits going on because of it.

    Also, one-hundred dollars!?!?!? The frick!?!?

  10. Joey: From what I gather, YouTube partnership cannot be offered to people who do the kind of videos that Austin and Co. do because it is not content entirely owned by Austin (as in the visuals of the video and the game soundtrack etc). The T&Cs of YouTube state that.

    Navy1227: It's not quite as simple as e-mailing saying 'oh by the way, no infringement intended'. Austin will need to pay royalties I believe on both the soundtrack and the video separately AND he'll need permission to make a sale on these items in the first place.

    Fair Use Policies are only covered if a person, for example, puts a video on the internet (like YouTube) and doesn't charge for it. However, once money starts being made specifically for that material, it becomes infringement and it some cases Piracy (although of course I don't believe that's the case here, since Austin isn't selling the game itself or its soundtrack)

    These things aren't sadly as simple as assuring the right people that you mean well :(

  11. @Rae aren't there some people who are still partners and really only commentate over games? I watch a few guys who are partners and all they ever put out is gameplay with a commentary, but I wouldn't know, I've never looked it up.
    and wow, one hundred dollars?! that is sweet.
    as long as the internet and youtube stay up forever I'd be fine without a dvd, but shirts would be awesome.

  12. There is Machinima, but I believe they're authorised to show their stuff. No unauthorised or unsolicited gaming channels are partnered.

    Plus for the record there are a great number of YouTube Downloaders if you want the video files for yourselves.

  13. It doesn't really matter because of youtube and such we can still watch the videos. But who wouldn't want Austin's autograph? He is an epic man but I don't have a credit car so I won't get anything. Oh well, I think Austin is very rich now, and that makes most people happy. Austin, you are a lucky man.

  15. Ahhh, well- I hate to be the bearer of bad news guys, but as Rae said it's not legal for them to technically use the DVD's to make money. Because while the commentary is their own, they made their popularity based off of a copywritten game. Unless they got permission from the creator of L4D/Valve, it's pretty much impossible. And even if they did, YouTube's rules are against using copywritten materials for profit (hence why, at one point, a lot of LP channels were getting shut down). It's not just the game--it's the video, the audio, and everything in between that would get them in trouble for including in sale.

    As for who has a problem with selling DVD's in the group, it really shouldn't matter. They probably realize all this and that's probably the main reason they stood against it. Leave 'em be.

    Any rate; Sorry, Austin :( You were probably looking forward to it. I know I was, but I understand :S

I can rip the videos myself and burn them anyway, I just thought it'd be a cool idea to have the extras you mentioned :P I think giving them away is totally legal, actually, as long as you're not making a profit off of them. the donation link does not specify that it's for paying for the DVDs. as long as you receive no payment for someone else's copyrighted material there's no infringement. I think. but I'm not a lawyer, either lol.

    but, I'm more likely to buy a t-shirt anyway! so I hope you guys think about that :) the Austin shirt should be Zoey saying, WHAT the FRICK!?!? lol.

  21. How about those who donate 75-100 dollars have a game with Kilplix. (If too many gave you that amount of money, simply have a raffle drawing for those who sent you that amount of money to choose the person) Those on PC are gonna be lucky if this happens but those on 360 on PS3 would be kind of cheated, but instead of L4D on 360 and PS3, it could be any other game of their choice as long as you own it. I'm sure it'd make a lot of people happy, those who donated to you all that cash and they get a nice little treat as well as an autograph.
